DECRETO N° 16.132, DE 25 DE AGOSTO DE 1923

Promulga as resoluções contendo emendas aos arts. 4º, 6º, 12, 13, 15, 16,e 26 do Pacto da Liga das Nações, adoptadas nas sessões de 3, 4 e 5 de outubro de 1921.

O Presidente da Republica dos Estados Unidos do Brasil :

Havendo sanccionado, pelo decretos n. 4.611 de 29 de novembro de 1922, a resolução do Congresso Nacional que approvou as resolução contendo emendas aos arts. 4º, 6º, 12, 13,15,16 e 26 do Pacto da Ligadas Nações, adoptadas nas sessões de 3, 4 e 5 de outubro de 1921, na assembléa da mesma liga, reunida na cidade de Genebra , e tendo-se effectuado o deposito do instrumento brasileiro de passado, naquella cidade:

Decreta que as referidas resoluções appensas por cópia ao presente decreto, sejam executadas e cumpridas tão fielmente como nelles se contem.

Faço saber aos que a presente Carta de Ratificação virem, que os Estados Unidos do Brasil e outros paizes representados na segunda Assembléa da Liga das Nações, que se reuniu, em Genebra, de cinco do Setembro a cinco de Outubro de  mil novecentos e vinte e um, concluiram e approvaram sete Resoluções, contendo emendas aos artigos 4, 6, 12, 13, 15, 15 e 26 do Pacto da Liga, tendo assignado os respectivos Protocollos, tudo do teôr seguinte:

PROTOCOLE

RELATIF A UN AMENDEMENT L’ARTICLE  4 DU PACTE.

La deuxieme Assemblée de la Société des Nations, sous la présidence do Son Excellence le Jonkheer H. A. van Karnebeek , assisté de I’Honorable sir Eric Drummond, Secrétaire général, a adopté dans sa séance du 5 octobre 1921, la résolution suivante, comportant amendement á I’article 4 du Pacte.

«L’alinéa suivant seva inséré entre le deuxième et le troisième alinéa de I’article 4:

«L’Assemblée fixe, à la majorité des deux tiers  les régles concernant les élections des Membros non permanents du Conseil, et en particulier, celles coucernant la duréc de leur mandat et les conditions de  rééliigibilité. »

Les soussignés, dûment autorisés, declarent, accepter, au nom des Membres de  la Société qu’ils représentent, I’amendement, ci-dessus.

Le présent protocole restera ouvert á la signature des Membres de la Société; il sera ratifié et les ratifications seront déposées aussitôt que possible au Secrétariat de la Société.

II entregra on vigueur conformément aux dispositions de I’article 26 du Pacte.

Une copie certifiée conforme du présent protocole sera transmise par le Secrétaire général à tous les Membres de la Société.

OF AN AMENDMENT TO ARTICLE 4 OF THE COVENANT.

The Second Assembly of the League of Nations, under the Presidency of His Excelleney, Jonkcheer H. A. van Karnebeek, with the Honourable Sir Eric Drummond, Secretary-General, adopted at its meeting of October 5th, 1921, the followng resolution, being an Amendment to Article 4 of the Covenant.

« The following paragraph shall be inserted  between the second and third paragraphs of  Article 4:

« The Assembly:shall fixby a two-thirds matajority the rules dealing with the election of the non-perma

nent Members of the Council, and particularly such regulatins as relate to therm of office and the conditions  of re-eligibility. »

The undersigned, being duly authorised, declare that they accept, on behalf of the  Members of the League which they represent, the above amendment.

The  present  Protocol wiil remain open for signature by the Members of the League; it, will be ratified and the ratifications will be deposited as soon as possible with the Secretariat of the league.

It, will come into force in  accordame  with the provisious of Article 26 of the Covenant.

A certified copy of the present Protocol will be transmitted by the Secretary-General to all Members of the  League.

RELATIF A UN AMENDEMENT A L'ARTICLE 6 DU PATC.

La deuxiéme Assemblée de la Société des Nations, sous la présidence de Son Ecellience le Jonkheer H. A. van Karnebeek, assisté de I’Honorable sir Eric  Drumnond, Secrátaire, général, a adopté , dans sa séance du 5 octobre 1921, la, résolution suivante   comportant amendement, à I’annexe du Pacte.

"Que la liste suivante soit inséréc à I’annexe au Pacte:

RÉPARTITION DES DÉPENSES DE LA SOCIÉTÉ

Les soussignés, dúment autorisés, déclarent accepter, au nom des Membres de la Société qu’ils représentent, I’amendement ci-dessus.

Le présent protocole restera ouvert á la signature des Membres de la Société; il sera ratifiá et les ratifications seront déposées aussitôt que possible au Secrétariat de la Société.

II entrera en vigueur conformément aux dispositions de I’article 26 du Paete.

OF AN AMENDMENT TO ARTICLE 6 OF THE COVENANT.

The Second Assembly of the League of  Nations, under the Presidearcy of His Excellency, Jonkheer H. A. van Karnebeck, with the Honourable Sir Eric Drummond, Secretary-General, adopted at its meeting of October 5th, 1921 , the follwing resolutiou, being an Amendment to Annex of the Covenant.

"That the following shall be inserted in the Annex to the Covenant:

III.

ALLOCATION OF THE EXPENSES OF THE LEAGUE

The undersigned, being duly authorised, declare that they accept, on behalf of the Members of the League which they represent, the above amendment.

The present Protocol will remain open for signature by the Members of the League; it will be ratified and the ratifications will be deposited as soon as possible with the Secretariat of the League.

It will come into force in accordance with the provision of Article 26 of the Covenant.

A certified copy of the present, Protocol will be transmitted by the Secretary-Gereral to all Members of the League.

Done at Geneva, on the fifth day of October, one thousand mne hundred and twenty-one, in a single copy, of which the French and English texts are both authentic and which will be Kept in the archives of the Secretariat of the League.

RELATIF A UN  AMENDEMENT A  L'ARTICLE  12 DU PACTE.

La deuxième  Assenblée de a Société dos  Nations, sous la présidence de Son Exxellence  le Jonkhacer H. A. van Kanebeek, assisté  de I’Horiorable sir Eric Drummond, Secrétaire  général, a adopté, dans sa  séance du 4 octobre 1921, la résolution suivante, comporant amendement à I’article 12 du Pacte.

L’article 12 sera rédige comme suit;

Article 12.

«Tous les Membres de la Société conviennent que, s’il s’élève entre eux un différend susceptible d’entratner une rupture, ils le soumettront, soit á la procédure de I'arbitrage ou á un règlement judiciaire, soit á I’examen du Conseil. Ils conviennent encore qu’en aucun cas ils ne doivent recourir á la guerre avant I’expiration d’un délai de trois mois après la décision arbitrale ou judiciaire, ou le rapport du Conseil.

« Dans tous les cas prévus par cet article, la décision doit être rendue dans um délai raisonnable, et le, rapport du Conseil doit être établi dans les six mois à dater du jour ou il aura été saisi du différend.»

Les soussinés, dûment autorisés, déclarent, accepter, au nom des Membres de la Société qu’ils représentent, I'amendernent ci- dessus.

Le présent protocole restera ouvert á la signature des Membres de la Société; il sera ratifié et les raifications seront déposées aussitôt, que possible au Secrétariat, de la Société.

II entrera en vigueur conformément aux disposition de l’article 26 du Pacte.

OF AN AMENDMENT TO ARTICLE 12 OF THE COVENANT.

The  Second Assembly of the League of Nations, under the Presidency  of His Excellency Jonkheer H. A. van  Karneheek , with the Honourable Sir Eric Drummond, Secretary-Geueral, adopled at  its meeting of October 4th, 1921, the following resolution, being an Amendment to Article 12 of the Covenant.

Article 12 shall read as folws:

Article 12.

« The Members of the League agree that, if there should arise between them any dispute likely to lead to a rupture, the will submit the, matter either to arbitration or judicial settlament or to enquiry by the Council and they agree in no case to resort to war until three  inonths after the award by the arbitrators or the judicial decision, or the report by the Council.

« In any case under this Article the a,ward of the arbitrator  or the judicial, decision  shall be made within a reasonabIe time, and the report of the Council shall be made within six months after the submission of the dispute. »

The undersigned, being duly authorised declare that they accept, on behalf of the Members of the League which they represent, the above amendment.

The present Protocol will remain open for signature by the Members of the League; it will be deposited as soon as possible with the Secretariat of the League.

It will come into force in accordance with the provisions of Article 26 of the Convenant.

A certified copy of the present Protocol will be transmitted by the Secretary-General to all Members of the League.

RELATIF A UN AMENDEMENT A L’ARTICLE 13 DU PACTE.

La deuxième Assemblée de la Société des Nations, sous la présidence de Son Excellence le Jonkheer H. A. van Karnebeek, assisté de l’Honorable sir Eric Drummond, Secrétaire général, a octobre 1921, la résolution suivante, comportant amendement à l’article 13 du Pacte.

«Les Membres de la Société conviennent que s’il s’élève entre eux un differend susceptible, à leur avis d’une solution arbitrale ou judiciaire, et si ce différend ne peut se régler de façon satisfaisante par la voie diplomatique, la question sera, soumise intégralement à un règlement arbitral ou jurdiciare.

« Parmi ceux qui sont généralement susceptibles d'une solution arbitrale ou judiciaire, on déclare tels less différends relatifs à l’interpreétation d'un traité à tional, à la réalité de toul, fait qui, s’il était établi, constiuerait la rupture d’un engagement international ou á l’etendue, ou à la nature de la réparation due pour une telle rupture.

«La cause sera soumise a la Cour permanente de Justice Internationale, ou a toute juridiction ou cour d´pesignée par les parties ou prévue dans leurs conventions antérieures.

«Les Membres de, la Socioétés s',engagent à  executer de bonne foi les sentences rendues, et à ne, pas recourir à la gerre contre tout Membre de la Société qui s’y conformera. Faute d’execution de la sentence le Conseil propose les mesures qui doivent en assurer l’effet.»

OF NA AMENDMENT TO ARTICLE 13 OF THE COVENANT

The Second Assembly of the League of Nations, under the Presidency of His Excellency Jonkheer H. A. van Karnebeck with the Honourable Sir Eric Drummond, Secretary-General, adopted at its meetinf of October 4th 1921, the following resolution, being na Amendment to Article 13 of the Covenant.

«The Membres of the League agree that, whenever any dispute shall arise between them which they recognise to be suitable for submission to arbitration or judicial settlement, and which cannot be satisfactorily settled by diplomacy, they will submit the whole subject-matter to arbitration judicial settlement.

«Disputes as to the interpretation of a treaty as lo any question of international law, as to the existence of any faet which, if established, would constitute a breach of any international obligation, or as to the extent and nature of the reparation to be made for any such breach, are declared to be among those which are generally suitable for submission to arbitration or judicial settlement.

«For the consideration of any such dispute, the couri to which the case is referred shall be the, Permanent Court  of International Justice, established in accordance with Article 14, or any tribunal agreed on by the parties to the dispute or stipulated in any conventiou existing between them.

«The Members of the League agree that, they will carry out in full good faith any award or decision that may be rendered and that they will complies therewith. In the event of any failure to carry out such an award or decision the Council shall propose what steps should be taken to give effect thereto.»

The undersigned, being duly authorised, declare that they accept, on behalf of the Members  of the League which they represent, the above amendment.

The present Protocol will remain open for si signature the Members of the League; it will be ratified and the ratifications will be deposited as soon as possible with the Secretariat of the League.

RELATIF A UN AMENDEMENT A L’ARTICLE 15  DU PACTE

La deuxième Assemblée de la socété des Nations, sous la présidence de Son Excellence le Jonkheer H. A. van Karnebeek, assisté de l'Honorable sir Eric Drummond. Secrétaire général, a adopté, dans sa séance du 4 octobre 1921, la résolution suivante, comportant amendement á.  l’article 15 du Pacte.

"Le premier alinéa da l’article 15 sera rédigé comme suit:

"Sil s’élève entre les Membres de la Société un différend susceptible d’entrainer une rupture et, si ce differend n’est pas soumis à la procédure de l’arbitrage ou à un règlement judiciaire prévu à l’article 13, les Membres de la Société conviennent de lé porter devant le Conseil. A cet effet il suffit que l’un d’eux avise de ce différend le Secrétaire général, qui prend toutes dispositions en vue d’une enquête et d’un examen complet.“

Les soussignés, dûment autorisés, déclarent accepter, au nom des Membres de la Société qu’ils représentent, l'amendement, ci-dessus.

OF AN AMENDMENT TO ARTICLE 15 OF THE COVENANT

The Second Assembly of fhe League of Nations, under the Presidentcy of His Excellency Jonkheer H. A. van karnebeek with the Honourable, Sir Eric Drummond, Secretary-General. adopted at its meeting, of October 4th, 1921. the following resolution. being, an Amendment to Article 15 of the Covenant.

"The first, paragraph of Article 15 shall read as follows:

"II there should arise between Members of the League any dispute likely to lead to a rupture, which , is not submitted to arbitration or judicial settlement accordance with Article 13 the Members of the League agree that they  will submit the matter to the Council. Any party to the dispute may effect such submission by giving notice of the existence of the dispute to the Secretary-General, who will make all necessary arrangements for a full investigation and consideration thereof."

The undersigned, being duly authorised, declare that they accept, on behalf of the Membres of the League which they represent, the above amendment.

The present Protocol will remain open for signature by the Members of the League: it will be ratified and the ratifications will be deposited as soon as possible with the Secretariat of the League.

It will come into force in accordance with the provisions of Article 26 of the Covenant.

RELATIVE A UN AMENDEMENT A  L'ARTICLE 16 DU PACTE

La deuxième Assemblée de la Société des Nations, sous la présidence de Son Excellence le Jonkheer H. A. van Karnebeek, assisté de l'Honorable sir Eric Drummond, Secrétaire général, a adopté dans sa séance du 4 octobre 1921, la résolution suivante, comportant amendement à l’article 16 du Pacte.

"La dernière partie du prefier alinéa de l’article 16 du Pacte sera rédigé comme suit:

„Ceux-ci s’engagent à rompre immédiatement avec lui toutes relations commerciales ou financières, à interdire tous rapports entre les personnes résidant sur leur territoire et celles résidant sur le territoire de l’Etat, en rupture de pacte et à faire cesser toutes communications financières, commerciales ou personnelles entre les personnes résidant sur le territoire de cet Etat et celles résidant sur le territoire de tout autre Etat membre ou non de la Société.“

Les soussignés, dûment autorisés, déclarant accepter, au nom des Membres de la Société qu’ils représentent, l’amendement ci-dessus.

OF AN AMENDMENT TO ARTICLE 16 OF THE COVENANT.

The Second Assembly of the League of Nations, under the Presidency of His Excellency Jonkheer H. A. van Karnebeek, with the Honourable Sir Eric Drummond, Secretary-General, adopted at its meeting of Octobre 4 th, 1921, the following resolution, being an Amendment to Article 16 of the Covenant.

"The latter part of the first paragraph of Article 16 of the Covenant shall read as follows.

"...which hereby undertake immediately to subject it to the severance of all trade or financial relations, the phohibition of all intercourse between persons residing in their territory and persons residing in the territory of the Covenant-breaking State, and the prevention of all financial, commercial or personal intercourse bethween persons residing in the territory of the Convenant-breaking State and persons residing in the territory of any other State, whether a Member of the League or not.

The undersigned, being duly authorised, declare that they accept, on behalf of the Members of the League which they represent, the above amendment.

The present Protocol will remain open for signature by the Members of the League: it will be ratified and the ratifications will be deposited as soon as possible with the Secretariat of the League.

It will come into force in accordance with the provision of Article 26 of the Covenant.

La deuxième Assemblée de la Société des Nations, sous la présidence de Son Excellence Jonkheer H. A. van Karnebeek, assisté de l'Honorable sir Eric Drummond, Secrétaire général, a adopté dans séance du 3 octobre 1921 la résolution suivante, comportant amendement à l'article 26 du Pacte.

«Le premier alinéa de l'article 26 du Pacte sera remplacé par le texte suivant:

«Les Amendements au présent Pacte dont le texte aura été voté par l'Assemblée à la majorité des trois quarts, parmi lesquels doivent figurer les voeux de tous les Membres du Conseil représentés à la réunion, entreront en vigueur dès leur ratification par les Membres de la Société dont les représentants composaient le Conseil lors du vote, et par la majorité de ceux dont les représentants forment l'Assemblée.»

Les soussignés, dûment autorisés, déclarent accepter, au nom des Membres de la Société qu'ils représentent, l'amendement ci-dessus.

OF NA AMENDMET TO ARTICLE 26 OF THE COVENANT.

The Second Assembly of the League of Nations, under the Presidency of His Excellency Jonkheer H. A. van Karnebeek with the Honourable Sir Eric Drummond, Secretary, General, adopted at its meeting of October 3rd, 1921, the following resolution, being an Amendment to Article 26 of the Covenant.

«The first paragraph of Article 26 of the Covenant shall be replaced by the following text:

«Amendments to the present Covenant the text of which shall have been voted by the Assembly on a three-fourths majority, in which therfe shall be included the votes of all the Members of the Council represented at the meeting, will take effect when ratified by the Members of the League whose Representatives composed the Council when the vote was taken and by the majority of those whose Representatives form the Assembly.»

The  undersigned, being duly authorised, declare that they accept, on behalf of the Members of the League whicj they represent, the above amendment.

The present Protocol will remain open for signature by the Members of the League, it will be ratified and the ratifications will be deposited as soon as possible with the Secretariat of the League.

It will come into force in accordance with the provisions of Article 26 of the Covenant.

E Tendo sido os mesmos Actos, cujo têor fica acima transcripto, approvados pelo Congresso Nacional, os confirmo e ratifico, e, pela presente, os dou por firmes e valiosos, para produzirem seus devidos effeitos, promettendo que serão cumpridos inviolavelmente.

Em firmeza do que, mandei passar esta Carta, que assigno e é sellada com o sello das Armas da Republica e subscripta pelo Ministro de Estado das Relações Exteriores.
