Dispõe sobre a execução do Quinto Protocolo Adicional ao Acordo de Alcance Parcial de Complementação Econômica nº 38, firmado entre a República Federativa do Brasil e a República Cooperativista da Guiana, em 3 de dezembro de 2010. |
O VICE-PRESIDENTE DA REPÚBLICA , no exercício do cargo de Presidente da República, no uso da atribuição que lhe confere o art. 84, caput , inciso IV, da Constituição, e
Considerando que o Tratado de Montevidéu de 1980, que criou a Associação Latino-Americana de Integração - Aladi, firmado pela República Federativa do Brasil em 12 de agosto de 1980 e promulgado pelo Decreto nº 87.054, de 23 de março de 1982 , prevê, em seus art. 8º e art. 25, a modalidade de Acordo de Alcance Parcial de Complementação Econômica com países e áreas de integração econômica da América Latina;
Considerando que os Plenipotenciários da República Federativa do Brasil e da República Cooperativista da Guiana, com base no Tratado de Montevidéu de 1980, firmaram em 27 de junho de 2001, em Brasília, o Acordo de Alcance Parcial de Complementação Econômica nº 38, promulgado pelo Decreto nº 3.989, de 29 de outubro de 2001 ; e
Considerando que os Plenipotenciários da República Federativa do Brasil e da República Cooperativista da Guiana, com base no Tratado de Montevidéu de 1980, firmaram em 3 de dezembro de 2010, em Montevidéu e Brasília, o Quinto Protocolo Adicional ao Acordo de Alcance Parcial de Complementação Econômica nº 38;
DECRETA:
Art. 1º O Quinto Protocolo Adicional ao Acordo de Alcance Parcial de Complementação Econômica nº 38, entre a República Federativa do Brasil e a República Cooperativista da Guiana, de 3 de dezembro de 2010, anexo a este Decreto, será executado e cumprido integralmente em seus termos.
Art. 2º Este Decreto entra em vigor na data de sua publicação.

ENTRE A REPÚBLICA FEDERATIVA DO BRASIL E A REPÚBLICA COOPERATIVISTA DA GUIANA
Quinto Protocolo Adicional
A República Federativa do Brasil e a República Cooperativista da Guiana, doravante as "Partes",
CONSIDERANDO o Acordo de Alcance Parcial assinado pelas Partes em 27 de junho de 2001, doravante denominado o "Acordo", e seu Artigo 31, que estabelece que emendas devem ser formalizadas por meio de Protocolos Adicionais;
LEVANDO EM CONSIDERAÇÃO- a Ata da reunião bilateral entre as Partes sobre o Acordo ocorrida em Brasília, em 15 de outubro de 2010;
Acordam o seguinte:
Artigo 1º. - Modificar o Anexo I do Acordo, incorporando à lista de preferências outorgadas pelo Brasil os produtos da lista constante do Anexo I do presente Protocolo, em NALADISA/SH 96, com 100% de margem de preferência.
Artigo 2º. - As regras de origem para os códigos objeto de concessão à Guiana deverão observar, conforme o caso, os requisitos de: a) mudança de posição tarifária ou 60% de agregação: do valor ou b) mudança de posição tarifária e 60% de agregação do valor. A lista do Anexo I estabelece o tratamento para cada código tarifário.
Artigo 3º. - As Partes intercambiarão comunicações sobre a conclusão dos procedimentos necessários à incorporação do presente Protocolo Adicional às respectivas legislações nacionais. O início de sua vigência ocorrerá a partir da data da última comunicação.
Em fé do que, os Plenipotenciários abaixo assinados, autorizados em boa e devida forma, apuseram suas assinaturas ao presente Protocolo.
Feito em Montevidéu e em Brasilia, em 03 de dezembro de 2010, em dois originais nos idiomas português e inglês, sendo ambos textos igualmente autênticos.
